ARTICLE 1: DEFINITIONS

If you are or want to become a member of us and use our services or products, we would like to do that with clear and transparent agreements. By registering you declare to accept these terms and conditions and the house rules of KEI Kung Fu and to act accordingly.
The general terms and conditions and the house rules can be found on www.KEIkungfu.nl.

KEI Kung Fu: By that we mean KEI Kung Fu V.o.f. and services and products that we offer under the KEI Kung Fu name.

KEI Kung Fu droplet: This is your access key to enter. It is therefore mandatory to check in at every visit.

Extra: these are the services or facilities that can be purchased for a fee from KEI Kung Fu in addition to the basic membership.

Effective date: The agreement starts on the day of your registration. The starting date is postponed if you use a promotion, for example free sports until 1 July. If, for example, you register on 12 May, the commencement date of your agreement is 1 July. The period between 12 May and 1 July you can of course already do sports and in the case of this promotion you do not owe any payment, subject to Article 6. This does not affect the fact that these conditions will apply from the time of registration.
Registration: a registration through which you become a member of KEI Kung Fu. This can be done in one of the ways described in Article 2a.

Youth member: You can become a member with us from the age of 4. You are a youth member between 4 and 16 years old. To become a youth member you must register at the academy with one of your parents or legal counselors who give their consent to your agreement by signing the agreement.

Virtuagym portal / app: This is our digital self-service portal that can be downloaded from the app store or google store. With this you can, among other things, register but also change data and add or change extras in your agreement.
Membership agreement or agreement: the agreement that arises between KEI Kung Fu and the member by registration. These terms and conditions are also part of your agreement, as are specific terms and conditions that may apply to extras.

ARTICLE 2: BECOME A MEMBER AND ACCESS

a. You are welcome to become a member of KEI Kung Fu. This is possible through an intake interview at the academy.
b. You have the right to cancel your contract within 14 days after the day of registration without giving reasons. You can do this in one of the ways described in Article 10c of these terms and conditions. If the 14th day falls on the weekend or on a nationally recognized public holiday, the reflection period runs until the end of the first following working day. If you decide to cancel your membership within the 14-day cooling-off period, and the membership has not been used during that period, this cancellation is free of charge. If the membership has been used during this period, then KEI Kung Fu can charge the membership fee pro rata (from the activation of the membership to the day of cancellation, including any registration fee).
c. If you become a member of KEI Kung Fu, you owe membership fees from the moment of registration. The automatic debit authorization will also apply from that moment. If you do not meet your payment obligation, KEI Kung Fu may decide to terminate the agreement. To enter the KEI Kung Fu academy you need your own KEI Kung Fu droplet.

ARTICLE 3: KEI Kung Fu droplet

a. The KEI Kung Fu droplet is the property of KEI Kung Fu and may be used during the agreement.
b. You cannot transfer your membership to someone else.
c. As a Member, you are responsible and liable for the method of use or abuse of the KEI Kung Fu droplet and membership. You must therefore ensure that the general conditions and house rules of KEI Kung Fu are respected and observed.
d. If you lose your KEI Kung Fu droplet or if it is stolen, you must purchase a new droplet at the academy. This will automatically block the old droplet. The replacement feefor a new one is €5,00

ARTICLE 4: MEMBERSHIP, TERM

a. We have various forms of membership, all details of which can be found on our website or at the academy. All forms of membership give access to the corresponding lesson times. With an Unlimited adult membership you have access to all adult lessons of KEI Kung Fu.
b. When registering you can indicate for which form of membership you want to enter into an agreement. All our membership forms are entered into for a fixed period of 1 year with an automatic extension for an indefinite period.
c. An exam fee is linked to each type of membership, which is collected annually at the start of a new period.
c. With all memberships you get access to the KEI Kung Fu app.

ARTICLE 5: EXTRAS

a. In addition to your membership form, we offer various extras, such as Events and Seminars. Up-to-date information, including rates for extras, can be found at www.KEIkungfu.nl or can be requested at the KEI Kung Fu academy.

ARTICLE 6: RATES AND PAYMENT

a. All forms of membership have their own membership rate and conditions, which can be found on the website or at the academy.
b. If you become a member of KEI Kung Fu we can charge a registration fee. This registration fee can vary per type of membership if there is a promotion. If you have terminated your membership and want to become a member again, you will again be required to pay a registration fee.
c. All membership fees are due and payable in advance.
d. If we are unable to collect your payment for any reason (such as a return, insufficient balance, etc.), we will send the payment to your bank again. If you do not meet your payment obligation, your KEI Kung Fu droplet will be blocked until the payment obligation is met.
e. If you do not meet your payment obligation even after we have given you notice of default, you are in default. At that time we can charge collection costs and we can hand over the claim. We can also terminate the agreement with immediate effect. At that time you owe all membership fees that should be paid during the term of the agreement plus the collection costs that are charged.
f. Once a year, as of January 1, we may increase our rates by a maximum of 5%. If we make use of this, it does not give the right to terminate the agreement, unless the rate increase takes place within three months after the conclusion of the agreement, or is higher than 5%. Rate adjustments due to government measures can be implemented immediately regardless of the amount and do not give the right to dissolution.
g. If you do not make use of the agreement or extras, the membership fee will not be refunded.



ARTICLE 7: OPENING HOURS

a. KEI Kung Fu indicates the opening times. It is possible that different opening times apply in circumstances. For example in case of emergencies or holidays. Sometimes we will close an academy. This may also be the case if, for example, we have to perform work in an academy.
b. We want to maintain our academy well and sometimes we cannot avoid a temporary or partial closure. In that case you are not entitled to a refund of membership fees.

ARTICLE 8: CHANGE OF GROUP LESSONS

a. We always want to keep the supply of our lessons up-to-date. This means that we can adjust the (content of the) lessons, the type of lessons and the timetable.

ARTICLE 9: REMOVAL OR BLESSURE

a. If you are moving outside the municipality, we will give you the option to terminate your agreement prematurely, subject to a cancellation period of 30 days, which commences at the time of receipt of the cancellation. In that case we will ask you to prove what your new home address is by means of a copy of the registration with your municipality.
b. We hope that you come to work with us in good health. If for medical reasons you can no longer make use of your membership, you can terminate it prematurely, subject to a cancellation period of 30 days from the notification. You must then provide proof that you are no longer able to use your agreement in view of your medical situation, for example through a doctor's statement.
c. Suspension of your membership for whatever reason is not possible.

ARTICLE 10: TERMINATE MEMBERSHIP

a. If you have entered into an agreement for the duration of one year, however you can cancel it with 60 days notice. For kids the cancellation is 30 days. After the annual agreement, the agreement will be extended for an indefinite period of time and can then be canceled at any time with a cancellation period of 30 days.
b. You can cancel your agreement by e-mail or by letter. When canceling by email or letter you must state the following information: your name, date of birth and address.
c. We strive to create an environment in the academy where everyone respects each other and the rules are observed. If you do not adhere to the agreements of the agreement, or if you do not comply with the house rules or show unacceptable behavior, then KEI Kung Fu can deny you access to the academy and terminate the agreement (immediately). The assessment of the situation is exclusively reserved for KEI Kung Fu.
d. Working out together is encouraged at KEI Kung Fu. Coaching other practitioners at the academy, however, is left solely to the instructors.

ARTICLE 11: RISK AND LIABILITY

a. KEI Kung Fu and our employees are not liable for material or immaterial damage as a result of an accident or injury that you sustain in our academy.
b. We advise you not to bring any valuables to the academy. KEI Kung Fu makes lockers available, but their use is at your own risk. Experience shows that no locker is safe for experienced thieves. KEI Kung Fu does not accept any liability for damage, loss or theft of your property.

ARTICLE 12: COMPLAINTS

a. We do our utmost to serve everyone at our academy. If you have any complaints, we regret that, but of course we would like to hear from you. You can contact the host / hostess or instructors in our academy

ARTICLE 13: PERSONAL INFORMATION

a. In order to implement your agreement, we have your personal data. KEI Kung Fu processes your personal data in a proper and careful manner and within the framework of the applicable laws and regulations, such as the General Data Protection Regulation (AVG).
b. The KEI Kung Fu privacy statement lists which data is processed by us, for what purposes we do it and how the personal data is handled. In addition, it is explained in which way data subjects can exercise their rights to the processing of their personal data. The privacy statement of KEI Kung Fu can be found on our website.
c. To protect the safety of people and goods in and around our academy, we use video and audio monitoring equipment to observe the academy 24 hours a day. Video and audio surveillance is limited to the counter and training rooms, and is not present in the toilet, shower and changing rooms.

ARTICLE 15: APPLICABLE LAW AND DISPUTES

a. Dutch law applies exclusively to these general terms and conditions and all agreements entered into by or with KEI Kung Fu.
b. All disputes arising as a result of the agreement between the member and KEI Kung Fu will be assessed by the competent court in the district where the academy is located.

Agreement Membership

I confirm my registration and authorize KEI Kung Fu v.o.f. Hereby to automatically direct debit the membership fee with regard to the chosen subscription type and annual fee from my bank account.

I also give permission to manage personal data and the data collected during the membership about me / my child by KEI Kung Fu and to save it in accordance with statutory law.

I declare to have read the General Terms and Conditions and to agree with their content.

House rules

Training is done exclusively in sportswear from KEI Kung Fu. A black jogging of training pants is mandatory. At registration, student receives a training shirt.

Water bottle and the like is allowed. However, consumption in the training room is not.

Always bring a towel.

Take personal hygiene seriously. Those who want to train barefoot should take good care of their feet.

Training room may not be entered with footwear.

Personal and / or valuable items may be stored in the lockers.

Jewelry may not be worn during the lessons.

During the summer holidays, training is done with an adapted schedule.

Training is entirely at your own risk. First aid diploma and first aid is available.

The gym is not responsible for theft of personal property from the changing room.

Respect your fellow practitioners and instructors; do not swear, swear, tease, bully, etc.

All warnings and instructions from the instructors must be strictly followed i.v.m. the safety.

During outdoor training you represent the school, you behave at all times.

Lost and found objects are kept for two months.

Members are aware that practicing certain sports involves risks. Every member must be in possession of a basic insurance as legally established (WA).

The student's illness / vacation / otherwise is no reason to get a discount on the monthly contribution.
